Please be aware that home sales and purchases may be a matter of public record, and your name and address, the price you paid, your property taxes, and other information may be available from public sites regardless of the brokerage(s), if any, who assist in the transaction.

3. Cookies and Other Tracking

When you use our website, we collect information from you by automatic means, including cookies (small text or electronic files, some of which may be placed on your device or browser) and pixel tags (small images embedded in our website or in ads). Cookies and pixel tags allow us to recognize and remember things about users of the website, such as their preferences, location, and saved searches; perform analytics, such as counting the number of users who have visited or used the website, determining how they got here, tracking their activity (including “clicks”) on the website, and gauging their interests; measure website performance; gather technical information about users’ devices, browsers, operating systems, IP addresses, etc.; assess and enhance our website’s performance, such as simplifying the log-in process; help protect our website against certain attacks; and assist with marketing. Specifically, the information we collect or obtain about you when you use our website or services (see “Personal Information We Collect or Obtain” above) may be shared with third-party vendors, so that we are better able to provide our services, including:

Union Street Media, which created and maintains our website and may provide digital marketing services for us
Third-party CRMs, which are automated Customer Relationship Management (CRM) platform that helps clients manage and engage more effectively with their clients and leads
Fluency, which is a digital advertising operating system that helps us manage client marketing

In addition, information on your usage of our website is provided to third-party vendors including Google, Facebook, Microsoft, Amazon, Basis, Benchmetrics, Bandwidth, and ClickCease for marketing, analytics, and fraud prevention purposes.

We do not sell (as defined in applicable privacy laws) your personal information for monetary or other consideration under any circumstances, nor do we use or share your personal information for targeted or cross-context behavioral advertising (as defined under applicable privacy laws) based upon your activities over time and across nonaffiliated websites or online services/applications, or for profiling in furtherance of decisions that produce legal or similarly significant effects on you (as defined under applicable privacy laws).
Finally, we may also disclose information about you if necessary to comply with applicable laws and regulations; to respond to any legal process or other lawful request for information we receive; to protect vital interests of you or another natural person; to detect, prevent, and investigate fraud, abuse, or other illegal activity; to defend our legal interests where necessary for our legitimate interests or the legitimate interests of others; or to otherwise protect our rights. In addition, we may transfer personal information we have about you in the event we sell or transfer some or all of our business or assets.

5. Links and Embedded Content

Our website may contain linked or embedded content from other websites or services that are outside our control and are not covered by this Privacy Notice. If you access those links or content, the operators of those websites or services may collect information from you that will be used by them for their own respective purposes and in accordance with their own respective privacy policies, which may differ from ours. We have no control over how other websites or services you elect to visit collect, use, or share your data.

6. Advertisements on Our Website

Our website may contain advertisements from third-party manufacturers, as well as blogs sponsored by third-party manufacturers, that may be of interest to you. Clicking on advertisements or on links in the blogs will take you to the manufacturers’ websites, which are outside our control and not covered by this Privacy Notice. The manufacturers operating those sites may collect personal information from you that will be used by them for their own respective purposes and in accordance with their own respective privacy policies. 7. Retention of Personal Information

We retain personal information for as long as reasonably necessary to achieve the purposes listed under “Why We Collect, and How We Use, Personal Information” section above, to provide customer service, to perform any other necessary tasks regarding our services, or to satisfy our legal obligations. After that period, and to the extent permitted by applicable law, we may delete, anonymize, de-identify, or dispose of your information.

8. Notice Regarding Children’s Privacy

We do not knowingly or intentionally request, collect, use, or share personal information from children under 13 years of age. If we discover or are notified that this has occurred, we will immediately delete the information from our servers and instruct any third parties with whom we have shared the information to do so as well.

9. Your Rights Concerning Personal Information

Please note that under certain circumstances we may not be able to honor requests to delete certain information.

Please note, however, that certain information may be exempt from such requests, such as if we need to keep the information to comply with our own legal obligations or to establish, exercise, or defend legal claims. If you are an Oregon resident, you may also obtain a list of the categories of your personal information we have processed and specific third parties to which we have disclosed personal information.

Nevada Residents. If you are a Nevada resident, you have the right to request that we not sell your “covered information” (as defined under Nevada law) to any person, by contacting us at the designated email address provided in the "How To Contact Us" section below. Any such request made to us must be verifiable before we have any obligation to fulfill it.

10. Exercising Your Data Rights

To exercise any of your applicable data rights as outlined above, or to withdraw any consent you have provided, please contact us via any of the means provided in the “How To Contact Us” section below. Any of the above data rights requests made to us must be verifiable before we have any obligation to fulfill them. A request must provide details sufficient to enable us to reasonably verify that you are the person about whom the requested information pertains. This verification process may include, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, phone number, or other information unique to you (e.g., a password).

Depending on where you reside, applicable law in your state may also allow you to designate an authorized agent to submit data rights requests on your behalf. In order for an authorized agent to be verified, the agent must provide us with signed written permission from you or a power of attorney. We may also follow up with you to verify your identity and permission before processing the authorized agent’s request.

Finally, under applicable law in your state of residence, you may also be entitled to appeal any decision we make with respect to your data rights request. To make an appeal, please contact us – within thirty (30) days of our decision – via any of the means provided in the “How To Contact Us” section below.

11. Additional Notice for California Residents

This section provides additional disclosures about our collection and use of personal information as that term is defined in the California Consumer Privacy Act of 2018 (“CCPA”).

In the past twelve months, we have collected the categories of personal information listed in the “Personal Information We Collect or Obtain “ and “Cookies and Other Tracking” sections above, and in that same period we have disclosed those categories of information to the categories of third parties listed in the “Sharing and Disclosure of Personal Information” section above.

We do not sell (as that term is defined in CCPA), and have not sold, personal information of California residents, including minors under 16 years of age.

We do not collect, use, or disclose “sensitive personal information” (as that term is defined in CCPA) except as necessary to provide our services to you.

We do not share (as that term is defined in CCPA) personal information (including for minors under 16 years of age) with third parties for cross-context behavioral advertising.

Finally, California’s “Shine The Light” law provides California residents the right under certain circumstances to request a disclosure regarding the sharing of certain categories of personal information (as that term defined in the law) with third parties for their direct marketing purposes. We do not share your personal information with third parties for their direct marketing purposes within the meaning of that law.

12. Notice for European Economic Area and United Kingdom Residents

This section applies only to residents of the European Economic Area (“EEA”) or the United Kingdom (“UK”). For purposes of the EU General Data Protection Regulation (“GDPR”) and the UK GDPR, Union Street Media is a data controller as defined in these laws with regard to any data we collect from and about you that can be used to personally identify you (“personal data”).

If you are resident of the EEA or the UK, GDPR allows us to process your “personal data” only if we have a “legal basis” to do so. Our legal bases for processing your personal data are as follows:
